There are many factors that could affect an individual's capacity to run their personal and financial affairs, and make their own decisions. These include severe learning disabilities, mental health problems, a brain injury or stroke, an accident causing severe injury, or simply old age.

Enable Law's knowledgeable specialist team understands the issues which arise from those suffering from a lack of capacity and have the skills to advise and assist with both contentious and non-contentious issues. Within our team, we have lawyers who are members of Solicitors for the Elderly, STEP, the Law Society Private Client section and Clinical Negligence Specialist Panel.

This specialist team can offer extensive services including Lasting Powers of Attorney, acting as or for deputies, making applications to the Court of Protection, professional deputyships, expert witness service, Living Wills and acting as litigation friends.

We are able to offer a collaborative approach between the non-contentious and contentious aspects of Court of Protection work and are often instructed by the Official Solicitor to act in the interests of clients who are not able to manage their own affairs.

About Patricia Wass

As a consultant in the mental capacity team at Enable Law (part of the Foot Anstey Group) specialising in Powers of Attorney and Court of Protection work, Patricia has been recognised as a Top Ranked 'Leader in her Field' by Chambers UK legal directory and has written for the Law Society and the Elder Law Journal as well as being interviewed by industry publications including STEP and CityWealth Magazine.

With over 30 years' experience working as a Solicitor dealing with all aspects of private client law and legal issues relating to the elderly and vulnerable, Patricia and the mental capacity team are highly regarded for their high value Deputyship work acting for clients who have suffered a traumatic brain injury as a result of a negligent birth delivery or a personal injury following an accident.

Patricia supports a number of brain injured clients and assists in buying and adapting properties for them, arranging Care Teams, Case Managers and relevant therapies and investing monies for them recovered as part of a settlement. Patricia also supports a number of elderly and vulnerable clients suffering from dementia illnesses. She has acted as a Panel Deputy for the Office of the Public Guardian, one of only 71 people appointed in this role throughout England and Wales. She lectures regularly on her practice area for various legal training providers and contributes articles to legal journals.

Patricia is the immediate Past Worldwide Chair of the Society of Trust & Estate Practitioners and also holds (or has held) the following roles:

  • Chair of the West of England STEP Committee between 2006 and 2009
  • Past Chair of the Law Society Private Client Executive Committee
